The law covers residences in foreclosure which is one that is occupied by the owner, the owner's spouse, or the owner's former spouse. If it is vacant, this law does not apply.
However, you cannot circumvent the law by telling the homeowner to move. Additionally, I would recommend maintaining a government issued ID and utility bill that shows the owner living somewhere other than the property being purchased.
