I was given a copy of the case from the investor who asked me to help him with this.
He has broken every part of the law but not to the extreme that is stated in the suit.
The part that is not going to be overlooked or diminished is where the investor does not have a notarized consulting agreement or purchase contract directly between the investor and the seller and did not give the seller the right of rescission as required by law.
The law specifically states that you cannot encumber the property without giving them their right of rescission and the Notice of Transfer of Deed or Title.
This puts the lender in a precarious position as well and is why the lender is listed as a defendent in the case.
